The most fundamental form of a citizens' participation in the public affairs is exercising their right to vote. According to the article 30 of the Constitution of the Slovak Republic (Act no. 460/1992 Coll., hereinafter only as „Constitution“) “Citizens enjoy the right to participate in public life either directly or by a voluntary selection of their representatives.”
Pursuant to the Constitution, the conditions for exercising the right to vote are stipulated by a separate law, Act no. 333/2004 Coll. on Election to the National Council of the Slovak Republic, as amended (hereinafter only as „Parliamentary Elections Act“). Legal framework for the elections is created mainly by the Constitution and the Parliamentary Elections Act.
Right to vote for representatives to the National Council – the so called “active election right” is granted to every citizen of the Slovak Republic, who is at least 18 year old on the election day (more in the article Elections to the National Council of the Slovak Republic). Foreigners with permanent residence in Slovakia are granted a right to vote and to be elected to the self-governing bodies of the upper-tier territorial units (municipalities), but cannot vote in the elections to the National Council (more in the article Regional elections).
