If you come from outside EU/EEA area and you intend to work in Slovakia you will probably need a work permit in addition to a residence permit. Whether you are required to obtain a work permit or not depends, for example, on the type of your residence permit, the type of work you want to do, the length of your residence in Slovakia and other circumstances.

Special conditions apply to EU/EAA nationals, who are not required to have a work permit. The following information applies to the so-called third country nationals (outside EU/EEA area):

Work permit is not required, if the foreigner:

  • is EU/EEA citizen (residence permit is not required as well);
  • has a permanent residence permit in the Slovak Republic;
  • has been granted a temporary residence permit for the purpose of employment and has had an uninterupted temporary residence in Slovakia for at least 5 years;
  • has been granted a temporary residence permit for the purpose of a family reunion, and entering into labor or similar employment relationship is allowed by the Act on Residence of Foreign Nationals (persons, who have been granted a temporary residence for the purpose of a family reunion with a foreigner who also has a temporary residence permit for the purpose of employment or business can get employed twelve months after first being granted the residence permit);
  • has been granted a temporary residence permit for the purpose of study and his/her employment in the territory of the Slovak Republic does not exceed ten hours per week or a corresponding number of days/months in a year;
  • has been granted a temporary residence permit for the purpose of special activity in field of research or development and his/her employment in lecturing does not exceed 50 days per year;
  • has been granted a temporary shelter in the territory of the Slovak Republic according to the Act on Asylum;
  • has been granted asylum;
  • is an asylum seeker and the his/her employment is allowed by the Act on Asylum (one year after completing the asylum procedure);
  • is a "Slovak National Living Abroad" (expatriate Slovak national);
  • is employed in the territory of the Slovak Republic for no longer than seven consecutive days or altogether thirty days within one calendar year and at the same time he/she is:
    • a teaching or academic staff of the university, scientific, research or development worker who is a participant of the expert scientific event;
    • a performing artist who is participating in the artistic event;
    • a person who is in the Slovak Republic providing the supply of goods or services; delivering goods or carrying out installation based on a business contract or carrying out a guarantee and repair work;
  • is accepted for employment based on an international agreement published in the Collection of Laws of the Slovak Republic, which is binding for the Slovak Republic and which stipulates that work permit is not required for acceptance of such a foreigner into employment;
  • is a family member of a member of a diplomatic mission, an employee of a consular office or a family member of an employee of an international governmental organisation based in the territory of the Slovak Republic - if an international agreement concluded on behalf of the government of the Slovak Republic guarantees reciprocity;
  • is a member of a rescue unit and he/she is providing assistance on the basis of an international agreement on mutual assistance to eliminate the consequences of accidents and natural disasters and in the cases of humanitarian assistance;
  • is a member of the armed forces or a civil branch of the armed forces of the dispatching state;
  • is a working student who is performing work within the systematic professional preparation at schools and school establishments listed in the network of schools, school establishments or pre-school establishments;
  • has been seconded to work in Slovakia by the employer based in other EU member state to perform services provided by the employer;
  • is a partner in a business/company or an authorized representative of a business/company, who acts on its behalf by conducting activities in the territory of the Slovak Republic, or is a member of a cooperative association or a member of an authorized representative of a cooperative association or another body of a cooperative association, who is conducting activities for the cooperative in the territory of the Slovak Republic;
  • is employed in an international public transport company and he/she is seconded to work in Slovakia by his/her foreign employer;
  • is an accredited journalist.

Duty to Report Employment

Even if you do not need a work permit, your employer is obliged to inform the local Office of Labour, Social Affairs and Family about the commencement or termination of your employment by the means of so-called "Information card about commencement/termination of labour relation" in two copies. The form is available for download on the website of the Ministry of Labour, Social Affairs and Family and in every Labour Office and must be submitted at the Labour Office within 7 working days after the commencement/termination of the employment.

When the Work Permit IS required

You will need a work permit to be employed or do business in Slovakia, if you are not an EU/EAA national and no exemption from those listed above applies to you.

Work permit is also required if a third country national lives permanently in his/her domicile country and he/she regularly crosses the borders of the Slovak Republic in order to work in the territory of the Slovak Republic and if he/she returns home at least once a week.

Special Conditions of the Employment of Foreign Nationals

1. Foreign nationals with tolerated residence

In principle, a foreign national who has been granted a tolerated residence permit is not allowed to run a business and to work.

A foreign national can enter into labour relationship (but not run a business) during the period for which the tolerated residence permit was issued, if:

  • he/she has been granted a temporary shelter (work permit is not required);
  • he/she was granted a tolerated residence permit on the grounds of respecting his/her private and family life (a work permit is required, but the situation on the Slovak labour market is not taken into consideration);
  • he/she is a victim of trafficking in human beings and his/her tolerated residence permit was extended because his/her presence in the territory is necessary due to the criminal proceedings (a work permit is required, but the situation on the Slovak labour market is not taken into consideration).

2. Foreign Nationals with Subsidiary Protection

Foreign nationals who have been granted subsidiary protection according to the Act on Asylum due to immediate danger of serious injustice in their country of origin can work in Slovakia after obtaining a work permit (which is issued without the consideration of the situation on the Slovak labour market).
