When deciding on issuing a work permit, the Office of Labour, Social Affairs and Family is obliged to take into account also the current situation in the local labour market.
 
Situation on the Slovak labour market

If a foreigner applies for employment, the Labour Office is obliged to investigate existence of a citizen of the Slovak Republic fulfilling conditions for the vacant position in its register of unemployed persons. If such a job seeker is found, the Labour Office is obliged to prioritize the Slovak citizen over the foreign national.

The Labour Office regularly informs the Central Office of Labour, Social Affairs and Family of the Slovak Republic about vacant positions for foreigners.

The Labour Office will grant a work permit to a foreign national only if the vacant position cannot be filled by a job seeker listed in the job seekers register.

The Labour Office will issue the applicant for work permit a confirmation about existence of a “free” position which is attached to the application as one of the annexes.

However, it is possible to employ a foreigner even in spite of unfavourable situation in the labour market, if an employer can justify the reason why it is important to employ this particular foreigner (it could be for instance specific abilities or language knowledge etc.).

The Labour Office always takes into account the situation in the labour market – aside from exceptions listed in Article 22 (5) of the Act No. 5/2004 Coll. on Employment Services (see below).

HOWEVER, SITUATION ON THE LABOUR MARKET IS NOT TAKEN INTO ACCOUNT IN THE FOLLOWING CASES:
  • If it is stipulated in an international treaty binding for the Slovak Republic and which is published in the Collection of Laws of the Slovak Republic
  • In case of interns (a person employed for a fixed period – maximum one year – for the purpose  of increasing qualification)
  • In case of students in exchange programs (a person up to 26 years of age, employed for occasional and time-limited work within the exchange between schools or within  the youth programs in which the Slovak Republic is participating)
  • In case of scientists and teachers (a person who performs continuous educational activity as a pedagogic or academic employee of a university, or as a scientific, research or development employee in research activity in the Slovak Republic)
  • In case of priests (a person who performs clerical activity authorised by registered churches or religious communities)
  • In case of a foreigner who was provided with subsidiary protection according to the Act on Asylum
  • In case of a foreigner whose tolerated residence permit was extended due to the fact he/she is victim of a criminal offence related to human trafficking
  • In case of a foreigner who was granted tolerated residence permit on the grounds of respecting his/her private and family life
